{"id":12174,"date":"2026-02-16T22:09:04","date_gmt":"2026-02-16T22:09:04","guid":{"rendered":"https:\/\/medirelaxa.com\/?page_id=12174"},"modified":"2026-02-16T22:09:04","modified_gmt":"2026-02-16T22:09:04","slug":"terms-and-conditions","status":"publish","type":"page","link":"https:\/\/medirelaxa.com\/en\/algemene-voorwaarden\/","title":{"rendered":"Terms and Conditions"},"content":{"rendered":"<h4 class=\"wp-block-heading\" id=\"artikel-1-definities\">Article 1 - Definitions<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Reflection period<\/strong>: the period in which the consumer can exercise his right of withdrawal;<\/li>\n\n\n\n<li><strong>Consumer<\/strong>: the natural person acting outside his profession or business who enters into a distance contract with the entrepreneur;<\/li>\n\n\n\n<li><strong>Bye<\/strong>: calendar day;<\/li>\n\n\n\n<li><strong>Duration transaction<\/strong>: a distance contract for a series of products and\/or services, where the obligation to deliver is spread over time;<\/li>\n\n\n\n<li><strong>Durable data medium<\/strong>: any means by which the consumer or entrepreneur can store information in a way that allows future reference and unaltered reproduction;<\/li>\n\n\n\n<li><strong>Right of Withdrawal<\/strong>: the possibility for the consumer to waive the distance contract within the cooling-off period;<\/li>\n\n\n\n<li><strong>Model form<\/strong>: the form provided by the entrepreneur that the consumer can fill in to exercise his right of withdrawal;<\/li>\n\n\n\n<li><strong>Entrepreneur<\/strong>: the natural or legal person offering products and\/or services to consumers at a distance;<\/li>\n\n\n\n<li><strong>Remote Agreement<\/strong>: an agreement where, within the framework of a system for distance selling organized by the entrepreneur, exclusive use is made of one or more techniques for distance communication up to and including the conclusion of the agreement;<\/li>\n\n\n\n<li><strong>Technology for remote communication<\/strong>: means that can be used to conclude an agreement, without the consumer and entrepreneur being together in the same room at the same time;<\/li>\n\n\n\n<li><strong>Terms and Conditions<\/strong>: the present General Terms and Conditions of the entrepreneur.<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-2-identiteit-van-de-onderneming\">Article 2 - Identity of the company<\/h4>\n\n\n\n<p>Company identity: Medirelaxa (Gelasco)<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Address: Blaubergsesteenweg 63C, 2230 Herselt, Belgium<\/li>\n\n\n\n<li>Phone number: +32 456 38 15 33<\/li>\n\n\n\n<li>E-mail address: <a href=\"mailto:info@medirelaxa.com\">info@medirelaxa.com<\/a><\/li>\n\n\n\n<li>Company number: 1000295870<\/li>\n\n\n\n<li>BTW-identificatienummer: BE1000.295.870<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-3-toepasbaarheid\">Article 3 - Applicability.<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The agreements are governed by Belgian law.  <\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-4-betaling\">Article 4 - Payment<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The invoice must be paid before delivery, unless otherwise agreed and explicitly mentioned on the invoice. Payment after this term or the due date mentioned on the invoice, shall automatically and without notice of default incur interest equal to 10% per year, as well as (also automatically and without notice of default) a lump sum compensation of 10% on the invoice amount with a minimum of 50 EUR as damages. Non-payment on the due date of the invoice makes all invoices, even if not yet due, immediately payable without further notice of default and releases the seller from any further performance of its obligations. <\/li>\n\n\n\n<li>The amounts on the website and invoice always exclude import fees, customs fees, shipping costs and VAT. The buyer should pay the transportation related costs himself.<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-5-aanvaarding-verkoopsvoorwaarden\">Article 5 - Acceptance of terms of sale<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Every order means acceptance by the customer of our terms and conditions, regardless of how the order is made.<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-6-gebreken\">Article 6 - Defects<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>By receiving or taking delivery of the goods, the buyer expressly acknowledges that the merchandise corresponds to his order and is free of any visible defect. Other defects must be notified in writing by the buyer to the seller immediately upon their discovery. Complaints concerning the goods or services delivered cannot be accepted if they do not reach us in writing within seven days of delivery. After this period, deliveries and invoices are deemed to have been accepted by the buyer without any reservation.<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-7-annulatie\">Article 7 - Cancellation<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>If the customer terminates or cancels the contract or if the contract cannot proceed due to his action, he shall owe us compensation in the amount of 50% of the total amount of the order with a minimum of 75 EUR.<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-8-vervoer\">Article 8 - Transportation<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>If delivery cannot be made to the desired location, for example, due to too small a passage, too high a floor, too heavy, etc. , then additional costs will be recovered from the buyer.<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-9-eigendom\">Article 9 - Ownership<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>The merchandise delivered remains our property as long as the full price (principal, costs and interest) has not been paid. The transferee shall bear the risks from delivery. He must keep the goods in their condition. All payments shall be applied to settle the oldest existing debts by applying them first to the costs, interests and possible damages due and then to the principal sum.<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"artikel-10-interest\">Article 10 - Interest<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li>in the event of non-payment of the invoice on the due date, interest shall be charged ipso jure and without notice of default. This late payment interest shall be calculated on the basis of the ECB reference interest rate.<\/li>\n\n\n\n<li><\/li>\n<\/ol>\n\n\n\n<p><strong>Article 11 - Limitation of Liability.<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>General<\/strong>: Entrepreneur shall not be liable for any damages, direct or indirect, resulting from the use of the products or services, unless intentional or grossly negligent.<\/li>\n\n\n\n<li><strong>Webshop and Website<\/strong>: The entrepreneur cannot be held liable for damages resulting from malfunctions, errors, interruptions or technical problems of the website, including but not limited to loss of data or delay in orders.<\/li>\n\n\n\n<li><strong>Medical Use<\/strong>: The products sold by the entrepreneur, such as massage chairs, are not intended for diagnostic or therapeutic purposes and should not be considered medical devices. Their use is entirely at the buyer's risk. If in doubt about their use, the buyer should consult a physician.<\/li>\n\n\n\n<li><strong>Force majeure<\/strong>: The entrepreneur is not liable for delays or failure to fulfill obligations due to force majeure, such as natural disasters, pandemics, transportation problems, government measures or other unforeseen circumstances beyond the control of the entrepreneur.<\/li>\n\n\n\n<li><strong>External Parties<\/strong>: Costs and risks arising from the use of external parties, such as transporters or installers, shall be borne entirely by the buyer.<\/li>\n<\/ol>\n\n\n\n<p><strong>Article 12 - Intellectual Property Rights.<\/strong><br>All content on the Entrepreneur website, including but not limited to text, images, logos and videos, is the property of the Entrepreneur and may not be reproduced, distributed or used without prior written permission. Violation of these rights may result in legal action.<\/p>\n\n\n\n<p><strong>Article 13 - Online Orders<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Right of Withdrawal<\/strong>: The consumer has the right to cancel an order within 14 calendar days, unless the product is personalized or cannot be returned for hygienic reasons after opening the packaging.<\/li>\n\n\n\n<li><strong>Damage on Delivery<\/strong>: If the product is damaged during delivery, the buyer must notify the entrepreneur in writing within 48 hours.<\/li>\n\n\n\n<li><strong>Accurate Data<\/strong>: The customer is responsible for filling in data correctly while ordering. Any errors may result in additional costs, which will be borne by the customer.<\/li>\n<\/ol>\n\n\n\n<p><strong>Article 14 - Privacy and Data Protection.<\/strong><br>The entrepreneur handles personal data in accordance with the General Data Protection Regulation (GDPR). For more information, please refer to our privacy policy.<\/p>\n\n\n\n<p><strong>Article 15 - Disputes<\/strong><br>15.1. Complaints must be reported in writing and within a reasonable time after discovery of the defect. 15.2. All agreements are governed exclusively by Belgian law. 15.3. In the event of any disputes, only the courts of the district of Turnhout shall have jurisdiction.<\/p>\n\n\n\n<p>With these additional provisions, you are better protected against liability issues and your general terms and conditions comply with Belgian law.<\/p>\n\n\n\n<p><strong>Article 16: Delivery and Delivery Times<\/strong><\/p>\n\n\n\n<p>1.61. The delivery dates given by Medirelaxa are indicative and not binding. Under no circumstances can a delay in delivery give rise to compensation, price reduction or the dissolution of the contract. 16.2. Medirelaxa cannot be held liable for late deliveries due to the carrier or unforeseen circumstances beyond our control (force majeure). 16.3. If a product is out of stock, the customer will be notified. Medirelaxa reserves the right to deliver the order in parts.<\/p>\n\n\n\n<p><strong>Article 17: Right of Withdrawal and Return Terms.<\/strong><\/p>\n\n\n\n<p>17.1. For consumers (B2C): The consumer has the right to withdraw from the contract within a period of 14 days without giving reasons. This period expires 14 days after the day on which the customer or a third party designated by the customer, who is not the carrier, takes physical possession of the good. 17.2. The direct costs of returning the goods shall be borne entirely by the customer.1 7.3. The product must be returned unused, undamaged and in its original packaging. Products that have been installed, used or damaged are not eligible for refund.<\/p>\n\n\n\n<p><strong>Article 18: Warranty conditions<\/strong><\/p>\n\n\n\n<p>18.1. <strong>For Business-to-Business (B2B) customers:<\/strong> There is no warranty period on all products unless otherwise agreed in writing. 18.2. <strong>Exclusions from Warranty:<\/strong> The warranty does not apply to: * Wear parts such as filters, seals, bulbs and other consumables. * Damage caused by improper or abnormal use of the product, such as but not limited to: * Failure to properly or regularly clean and maintain the unit as directed. * Turning on or using a water heater or heating element without being properly connected or filled with water. * The use of unsuitable or aggressive cleaning agents. * Damage resulting from external factors such as fire, water damage, limescale, lightning strikes or accidents. * Products where repairs or adjustments have been made by unauthorized technicians. 18.3. <strong>For consumers (B2C):<\/strong> The legal warranty of two (2) years, as stipulated in the Belgian consumer legislation, remains fully applicable. The above-mentioned exclusions for damage caused by misuse are also in force. <strong>18.4. Carry-in<\/strong> : Defective products benefiting from warranty must be brought in or sent to MediRelaxa at Blaubergsesteenweg 63C, 2230 Herselt, Belgium.<\/p>\n\n\n\n<p><strong>Article 19: Liability<\/strong><\/p>\n\n\n\n<p>19.1. Medirelaxa shall only be liable for direct damages resulting from proven gross negligence or intent. Our liability shall in all cases be limited to the invoice amount of the product in question. 19.2. Medirelaxa shall never be liable for indirect damages, such as lost profits, consequential damages, loss of clientele or any other form of economic loss.<\/p>\n\n\n\n<p><strong>Article 10: Intellectual Property and Media.<\/strong><\/p>\n\n\n\n<p>20.1. All text, images, videos and other material (hereinafter \u201cmedia\u201d) on Medirelaxa's website and other communication channels are protected by copyright and belong to Medirelaxa or its licensors. 20.2. <strong>Use of AI:<\/strong> Medirelaxa sometimes uses artificial intelligence (AI) to create textual and visual content. While we strive for accuracy, we cannot guarantee that all information generated by AI is completely error-free. 20.3. <strong>Removal request:<\/strong> We respect the intellectual property rights of third parties. If you believe that certain media on our channels violate your copyright, please contact us immediately at info@medirelaxa.com. Upon receipt of a justified request, we will remove the media in question as soon as possible.<\/p>\n\n\n\n<p><strong>Article 21: Retention of title<\/strong><\/p>\n\n\n\n<p>21.1. All goods delivered shall remain the exclusive property of Medirelaxa until the full purchase price, including any costs and interest, has been paid by the customer.<\/p>\n\n\n\n<p><strong>Article 22: Liability and Third Party Products.<\/strong><\/p>\n\n\n\n<p><strong>22.1.<\/strong> Medirelaxa acts exclusively as a reseller of the products offered on its website and in its other sales channels. Medirelaxa does not produce any products itself and the products are sold to the customer in their original condition, as supplied by the manufacturer.<\/p>\n\n\n\n<p><strong>22.2.<\/strong> In accordance with the Belgian Law on liability for defective products (Law of February 25, 1991 and the relevant provisions in the Civil Code), the producer or manufacturer of a product is liable for the damage caused by a defect in its product. Medirelaxa as a reseller cannot be held liable for any direct or indirect damage to third parties arising from the use, defect or operation of the products it sells. For such damage claims, the customer should contact the relevant manufacturer directly.<\/p>\n\n\n\n<p><strong>22.3.<\/strong> Upon the customer's request, Medirelaxa will provide, to the extent reasonably possible, the contact information of the manufacturer of the purchased product so that the customer may submit his or her claim directly to the manufacturer.<\/p>\n\n\n\n<p>22.4. The limitation of liability in this article does not affect consumers' legal rights, in particular the legal warranty for consumer goods.
